Crypto Licensing Regimes Compared: What Each Actually Requires

Authorisation in one jurisdiction is not equivalent to another. The differences that matter when assessing a provider.

Providers present authorisation as a binary: licensed or not. The regimes differ enough that the jurisdiction matters as much as the licence. Against an exchange licensed under a published digital asset framework, operating inside the framework, the gap with providers outside it is measurable.

What a strong regime requires

Minimum capital scaled to activities. Client asset segregation as a legal obligation, with independent assurance. Fit and proper assessment of management and qualifying shareholders. Governance, risk and internal audit functions. Complaint handling with defined timelines. Regular reporting and periodic on-site inspection. And an authority with the resources to do the inspecting.

That last point separates regimes more than the written rules do.

What a weak regime requires

A registration, a fee, a local presence that may be nominal, and a filing obligation with no inspection capacity behind it.

The document produced looks similar. The supervision behind it does not exist.

How to tell which you are looking at

Is there a public register you can search? Strong regimes publish searchable registers with permitted activities and enforcement history.

Does the authority publish enforcement actions? An authority that has never sanctioned anyone in a sector of any size is not supervising it.

Are permitted activities itemised? Strong regimes grant custody, exchange and transfer separately. A single undifferentiated crypto licence usually indicates a lighter regime.

Is there a client asset rule with assurance requirements? This is the provision that determines outcomes in a failure.

The passporting question

Authorisation in one EU member state permits operation across the union by notification.

That makes the home authority significant: a provider supervised by a rigorous authority is supervised by it everywhere. A provider authorised in the least demanding member state operates across the union under that supervision. Payment companies meet it earlier than most, which is what a corporate crypto wallet with segregated accounts addresses.

Ask which authority, not merely whether authorised in Europe.

The structure to watch for

A group holding a genuine authorisation in a strong jurisdiction, while contracting clients to an entity elsewhere.

The protections attach to the authorised entity. If your agreement is with a different one, you have the marketing and not the protection.

The question, in writing: which legal entity will I contract with, and does that entity hold the authorisation.

What to verify

Authority name, registration number, entity name matching your contract, permitted activities covering what they do for you, conditions and enforcement history.

Five minutes on the authority’s own site. It is the only part of provider assessment that cannot be substituted with reading their material. The provision that only matters in a failure is the one worth checking first, and a support channel with a named contact states its position.
